Third Voice Privacy Statement Our Company Third Voice, Inc. is a licensee of the TRUSTe Privacy Program. This statement discloses the privacy practices for the Third Voice Web site. When you visit a Web site displaying the TRUSTe trustmark, you can expect to be notified of: What personally identifiable information of yours is collected; What organization is collecting the information; How the information is used; With whom the information may be shared; What choices are available to you regarding collection, use and distribution of the information; What kind of security procedures are in place to protect the loss, misuse or alteration of information under the company's control; and How you can correct any inaccuracies in the information. Our Commitment to Privacy Dear Third Voice Members and Visitors, Third Voice, Incorporated provides Internet users with unique, interactive services enabling users to express themselves and to share their interests with other Internet users. Third Voice provides tools for users to post and read notes for virtually any Web page in the world. Users are registered members who can post and read notes. Third Voice is committed to respecting and maintaining the privacy of all users who visit our communities. We are thus providing this disclosure of our privacy practices and information uses. Third Voice collects the following personally identifiable information for members: Names, user names, and valid e-mail addresses. Third Voice typically collects this type of information when members initially register with Third Voice or download the Third Voice plug-in module. In other cases, Third Voice will give users explicit notice before collecting any other personally identifiable information. Such personally identifiable information will be used only for the purposes stated at the time of collection, and stated within this Privacy Statement. Third Voice also collects the following general demographic data that users may optionally provide: state, country, zip or postal code, age, and gender. Third Voice typically also collects this type of information when members initially register with Third Voice or download the Third Voice plug-in module. In other cases, Third Voice may invite users to enter other demographic data. Such demographic data will be used for the purposes described within this Privacy Statement. Third Voice also automatically collects the following computer-related information about users when users visit Third Voice Communities: the users' IP addresses, the users' computer operating systems, and the users' browser software. From the IP addresses, Third Voice may be able to determine users' Internet Service Providers and users' geographic connection locations. Other types of information are stored within Cookies and described below. Third Voice may save any and all posted notes that include members' user names. These messages are kept for an indeterminate amount of time at the sole discretion of Third Voice. Cookies Cookies are pieces of information that a Web site transfers to users' computer memory for record-keeping purposes. The use of cookies is an industry standard, and many major Web sites use them to provide useful features for their visitors. Cookies typically do not store personally identifying information, unless that information has been previously provided at the web site or unless the browser has been enabled to provide that information. Cookies typically identify users' computers. Third Voice is not generally interested in any one individual and does not collect personally identifiable information about users using cookies. Cookies enable Third Voice to track community usage and other aggregate information. For example, cookies allow Third Voice to track certain content viewed by users, such as, sponsor materials, content or sites users link to, and to determine how often Web pages are visited and how long users view particular content. By doing so, Third Voice can assess which discussion threads are Third Voice's most popular communities, and the like. Third Voice also uses cookies to monitor our services and improvements. Third Voice may use outside companies to provide sponsor materials on our web site. These sponsor materials may also contain cookies. Such cookies may be used by outside companies, however we do not have access to this information. When you provide us with registration information, you provide us with critical information that we use to better serve you and to optimize our service. For users who use the Third Voice service to post notes, we need you to register with us so that we can determine who you are and so that you can identify yourself, via your Third Voice user name, to other members. Third Voice uses the aggregate information to perform statistical analyses regarding the behavior of our members and visitors. Based upon the aggregate information we measure overall user demographics regarding specific areas of the Third Voice domain. We also use this data to analyze how and where to invest our resources to better service our members. Third Voice may use users' IP addresses to help diagnose problems with our server, and to administer our web site. Third Voice also uses users' provided e-mail address for sending e-mail message notifications and for account management, such as to provide technical support to users. Third Voice does not share any personally identifiable information with outside parties for commercial purposes, unless requested by the user. During the Third Voice registration process, users are given the choice whether or not to receive regular communication and/or sponsor material from Third Voice or our partners and sponsors. Users can update their choice by updating their user personal profile. We release personally identifiable information to our partners and sponsors for those users who choose to receive these materials from Third Voice or third parties. If you have any questions regarding the privacy policies of one of our sponsors, please contact that sponsor directly. The personally identifiable information that may be released with a user's consent includes: the users name and e-mail address supplied in the Third Voice registration and personal profile. Third Voice limits the sending of e-mail to members who have requested regular communications and/or sponsor materials. Such materials are limited in that, among other things, they must clearly indicate who is sending the e-mail message, and how users may opt-out of future e-mail messages. If, at any time, you decide that you would like to discontinue receiving these materials from Third Voice or its partners or sponsors, please change your personal profile to indicate your new choice using the Edit My Profile page. The number of people who have seen and clicked on advertisements, sponsor materials, Web sites, or links is also shared with Third Voice partners and sponsors. This type of information is aggregated and no personally identifiable information will be disclosed to any third party as a result of this process. Such data allows Third Voice to know which Third Voice communities are the most popular, and allows Third Voice to provide an effective forum for our partners and sponsors. Third Voice will provide information concerning any member, visitor, or notes as required by law, court order, or as requested by other government or law enforcement authority. We also reserve the right to release that information concerning a member who we believe is in violation of our content guidelines or Third Voice Service Terms, even without a subpoena, warrant, or other court order, although we have no obligation to do so. We will cooperate with law enforcement agencies in identifying those who use our servers for illegal activities. We also reserve the right to report any illegal activity to law enforcement for prosecution. Third Voice will not sell or rent personally identifiable information concerning any member or visitor to any third parties for any commercial purposes. Third Voice may save any and all posted notes. These messages are kept for an indeterminate amount of time at the sole discretion of Third Voice. Posted notes are typically accessible to all users. All public notes created by users are accessible by other Third Voice users; and all group notes are accessible by the users of a particular Third Voice user group. By the same token, personal notes are accessible only by the member who creates those messages. Third Voice may also choose to highlight particular public notes community discussions to other users. Third Voice does not allow our members or visitors to use Third Voice for the purpose of gathering personally identifiable information for commercial purposes or for unlawful purposes, except as provided above. A minimum amount of personal information is required to register with Third Voice. This is needed so we can communicate with our members. However, members can opt-out of receiving regular communications and/or sponsor materials during the registration process or at a later time by modifying their personal preferences using the Edit My Profile page. The personal information of our members may be changed by using the Edit My Profile page. To protect users' privacy and security, Third Voice will take reasonable steps to verify users' identities before granting access to personal information. We keep all user provided information for an indeterminate amount of time. If a member ceases to use Third Voice, there may be residual information which will remain within the Third Voice database and records. From time to time, we may contact non- active members. Security To prevent unauthorized access, maintain data accuracy, and ensure the appropriate use of private information, we have put in place appropriate physical, electronic and managerial procedures to safeguard and secure the personal information we collect online. 8. Disclaimer Third Voice hopes that all third parties involved adhere to our policies regarding the privacy of our members; however, Third Voice is neither responsible nor liable for any actions of third parties. You should also be aware that, although Third Voice respects the privacy of your e-mail messages, Third Voice makes no representation or warranties concerning our ability to keep your e-mail messages private. Links to third party sites may be provided by the Third Voice site. Users should understand that when they select such links, they may be transferred to third party sites. These third party sites are not bound to the principles set forth in this Third Voice Privacy Statement. 9. How else can I protect my privacy? Know the risks. Please remember that any information that is disclosed in most of Third Voice's communities are public information. Third Voice does not control the acts of its members and visitors. When you communicate with others online, you should be aware that, when disclosing personal information such as one's actual name, member name, e- mail address, etc., on a Web page, in a discussion forum, or in chat room, that such information becomes public. Accordingly that information may be collected and used by others to send unsolicited e-mail messages from parties, outside Third Voice. Some of the e-mail messages you receive may be useful to you, but some may not be. Third Voice cannot prevent information gathering robots called "harvesters" from traversing our domain, but in an effort to curtail unsolicited e-mail, we do our best to block these harvesters. You should also be aware that, although Third Voice respects the privacy of your e-mail messages, it makes no representation or warranties concerning our ability to keep your e-mail messages private. Educate yourself. Search the Web for as much information as you can about how to protect your privacy. Look for a privacy statement in the sites you visit. One good place to start is at TRUSTe -- an independent, non-profit privacy initiative dedicated to building users' trust and confidence in the Internet. Tell your children: "Never talk to strangers!" Tell them to not give out their names or other personal information on the Internet or elsewhere. They should also be instructed not to fill out any forms or register at any domain without your knowledge and consent. Use PGP (Pretty Good Privacy at www.pgp.com) or another encryption program. Understand the relative ease involved in cracking a password. Recognize, too, the necessity of inconvenience when passwords are involved, such a when you have to enter passwords with weird characters with those very long and awkward keystroke combinations. We only give member account passwords to the e-mail address that a given member account is registered to. To prevent access to your Third Voice account by anyone who should not have access, never give your password out to anyone, and always log out when working at a public computer. If someone claims to represent Third Voice in an e-mail message or a forum and asks for your Third Voice password, do not honor the request. We do not ask for passwords, except on our site in the places you need to access our system.
